Terms of Service

These terms govern your use of the Choovy platform. Please read them carefully.

1. Acceptance

By creating an account or using Choovy, you agree to these Terms of Service and our Privacy Policy. If you are using Choovy on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. The service

Choovy provides a digital menu creation and management platform. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will use commercially reasonable efforts to provide 99.5% monthly uptime.

3. Account rules

One account per restaurant. You must provide accurate information when creating your account. You are responsible for keeping your credentials secure and for all activity that occurs under your account. Notify us immediately at support@choovy.app if you believe your account has been compromised.

4. Acceptable use and prohibited content

You may not use Choovy to upload content that is illegal, infringes third-party rights, or is otherwise harmful. This includes: illegal content (controlled substances, weapons), adult or sexually explicit material, content promoting hate speech or violence, and spam. Violations are subject to a 3-strike policy — first two violations result in a warning and content removal; a third violation results in permanent account suspension with no refund for the current period. You may not reverse-engineer the service, circumvent access controls, or use automated tools to scrape or abuse the platform.

5. Content ownership

You retain all ownership of the menu content you upload. You grant Choovy a limited, non-exclusive license to process, store, and display that content solely for the purpose of providing the service to you and your diners.

6. Subscription and billing

Paid plans are billed monthly or annually in advance. All payments are processed by DodoPayments (dodopayments.com). DodoPayments handles payment processing, receipt issuance, and payment disputes on our behalf. Prices are in USD unless otherwise stated. If your payment fails, we will retry automatically over several days before suspending your account.

7. Trial terms

New accounts receive a 14-day free trial with full Pro plan access. No credit card is required during the trial period. After the trial expires, you must select a paid plan to continue using Choovy. If you do not subscribe, your account is automatically paused — no charge is made. We will send a reminder email before your trial ends.

8. Plan limits

The Starter plan allows 1 live menu and 1 language. The Pro plan allows up to 5 menus and 3 languages each. Publishing a menu on Starter when another is already live will automatically set the existing live menu to Draft. Exceeding plan limits in other ways will prompt an upgrade prompt.

9. Cancellation

You may cancel your subscription at any time from the Billing page in your dashboard. Cancellation takes effect at the end of your current billing period. Your data remains accessible for 30 days after cancellation, after which it is deleted.

10. Limitation of liability

Choovy is provided "as is." To the maximum extent permitted by law, Choovy's liability for any claim arising out of or related to the service is limited to the amount you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

11. Governing law

These terms are governed by the laws of the jurisdiction in which you operate your restaurant. Any disputes will be resolved in good faith through direct communication first. Where required by local law, alternative dispute resolution mechanisms apply.

12. Changes to these terms

We may update these terms from time to time. Material changes will be communicated by email at least 14 days before they take effect. Continued use of Choovy after that date constitutes acceptance.
